These Terms and Conditions (“Terms”) govern your use of the PropFlow AI-assisted real estate messaging platform operated by PropFlow (“Company,” “we,” “us,” or “our”). By submitting your contact information through a PropFlow-powered lead capture form, you agree to these Terms.

1. Description of Service

PropFlow provides AI-assisted SMS messaging technology that allows licensed real estate agents (“Agents”) to follow up with prospective buyers and sellers (“Leads”). Messages are delivered via Twilio and may be generated or assisted by artificial intelligence on behalf of the Agent.

2. SMS Messaging Program

By providing your phone number through a lead capture form associated with a PropFlow Agent, you expressly consent to receive recurring automated and AI-assisted text messages from that Agent at the number provided. These messages may include:

Lead qualification questions
Property information and listing updates
Appointment scheduling and reminders
General real estate follow-up communications

Message frequency varies. Message and data rates may apply. Consent is not a condition of any purchase or service.

3. Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message and no further messages will be sent. To re-subscribe, text START to the same number.

4. Supported Carriers

Carriers are not liable for delayed or undelivered messages. PropFlow supports all major US carriers including AT&T, Verizon, T-Mobile, and regional carriers.

5. Accuracy of Information

AI-generated messages are provided for informational and communication purposes only. Property information, pricing, and availability are subject to change. Always verify details directly with the Agent before making any real estate decisions. PropFlow makes no representations or warranties regarding the accuracy of AI-generated content.

6. No Real Estate Advice

PropFlow is a communication platform, not a licensed real estate brokerage. Nothing in our messages constitutes legal, financial, or real estate advice. All real estate transactions must be completed through a licensed real estate professional.

7. Prohibited Use

You agree not to:

Provide false or misleading information in lead capture forms
Use PropFlow's platform to harass or abuse Agents or other users
Attempt to reverse-engineer, scrape, or interfere with our systems
Use our messaging infrastructure for spam or unsolicited communications

8. Limitation of Liability

To the maximum extent permitted by law, PropFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of PropFlow or any messages sent through our platform. Our total liability shall not exceed $100.

9. Indemnification

You agree to indemnify and hold harmless PropFlow and its Agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of our platform.

10. Modifications

We reserve the right to modify these Terms at any time. The updated version will be indicated by a revised “Last updated” date. Continued use of our platform after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
